Returns & withdrawal

Two different things are covered here: changing your mind about a ready-made piece, and dealing with a piece that arrives faulty or not as described. The second applies to everything we sell, including bespoke work.

1. The short version

  • Ready-made piece bought at a distance: 14 days to change your mind, no reason needed.
  • Piece made to your specification: no right of withdrawal — this is a limit set by law, not by us.
  • Anything faulty, damaged or not as described: two-year statutory guarantee, always, bespoke included.
  • Damage in transit: tell us within 48 hours of delivery.

If you are unsure which case you are in, the proposal you accepted says whether the piece was made to your specification.

2. The 14-day right of withdrawal

Where you buy as a consumer at a distance or away from our premises, and the piece was not made to your specification, you may withdraw from the contract within 14 days without giving a reason.

The period runs from the day you, or someone you nominate, takes physical possession of the goods. Where an order is delivered in parts, it runs from the last part.

How to withdraw
  1. Tell us before the 14 days are up — an unambiguous statement is enough. E-mail emil.fardigital@gmail.com with your name, order reference and delivery date.
  2. You may use the standard withdrawal form set out in consumer legislation, but you do not have to.
  3. Send the goods back, or make them available for collection, without undue delay and no later than 14 days after telling us.

Sending the notice within the 14 days is enough — the goods do not have to be back with us by then.

3. Why bespoke pieces are excluded

Consumer law excludes the right of withdrawal for goods made to the consumer's specifications or clearly personalised. A bench cut to your wall length, in a wood and finish you chose, cannot be resold to anyone else, and the exclusion exists for exactly that reason.

In practice this covers most of what we make. We mark it plainly in every proposal, before you commit, so that you know which regime applies before the deposit is paid.

The exclusion has no effect on your rights if the piece turns out to be faulty or not as described. Those rights apply to bespoke work in full.

4. Condition, return costs and refunds

Condition

You may handle the goods as you would in a shop — enough to establish their nature, characteristics and working. You are liable for any diminished value resulting from handling beyond that.

Cost of return

You bear the direct cost of returning the goods. Furniture is bulky and that cost can be significant; we will tell you the likely figure on request before you decide. We can arrange collection on your behalf and pass on the carrier's charge.

Refunds
  • We refund all payments received from you, including the standard delivery charge, within 14 days.
  • Where you chose a more expensive delivery method than our standard one, we refund the standard amount.
  • We may withhold the refund until the goods are back with us, or until you supply proof of sending them, whichever is earlier.
  • Refunds go back by the same means you paid, unless you agree otherwise. There is no fee for this.

5. Faulty or non-conforming goods

The statutory guarantee of conformity runs for two years from delivery and applies to every piece we sell, bespoke included. It costs you nothing to rely on.

Where goods are not in conformity you may require repair or replacement. If that is impossible, disproportionate, or not done within a reasonable time and without significant inconvenience to you, you may require a proportionate reduction of the price or terminate the contract and be refunded.

What we need from you
  • Your order reference and the date of delivery
  • Photographs of the problem, and of the whole piece for context
  • A short description of where the piece has been kept and how it has been used

Natural variation and seasonal movement in solid wood are characteristics of the material, not defects. What that means in practice is set out in the terms, section 6.

6. Damage in transit

Check the piece when it arrives, before the delivery crew leaves if that is possible. Note any visible damage to the packaging or the piece on the delivery paperwork.

Tell us within 48 hours of delivery, with photographs of the packaging as well as the piece. We deal with the carrier; you do not have to.

Reporting after 48 hours does not remove your statutory rights, but it makes a transit claim considerably harder to establish.

7. Repairs outside the guarantee

We repair our own work for as long as it exists, whether or not the guarantee still runs, and charge only for materials and time.
